Sheriff’s sales, unless otherwise noted, will be conducted on the third Thursday of each month at 10 AM CST at the Gibson County Community Corrections Conference Room, located at 114 E. Emerson St. in Princeton, IN. For Sheriff Sales dated before 2024, please contact our office to get past records.
About

Sheriff Sales are the result of a court-ordered bank foreclosure for the non-payment of standard monthly mortgages. These sales are scheduled once each month (generally the 3rd Thursday of the month) and are held at the Gibson County Sheriff’s Office in the Community Corrections building. These sales should not be confused with “Tax Sales” which are held twice a year by the Treasurer’s Office for non-payment of real estate taxes. They are not the same thing.

Sheriff Sales are held at the Gibson County Sheriff’s Office Community Corrections building unless otherwise noted. Written bids are accepted on the day of the sale before 10:00 AM. Properties receiving multiple bids go to verbal bidding beginning at 10:00 AM. All bids are final and irrevocable.

Individuals bidding on these properties must have the funding available on the day of the sale. All bids must be paid IN FULL no later than 3 pm on the day of the sale by certified cashier’s check or bank check made payable to the “Sheriff of Gibson County”. Letters of credit or other letters of verification are not accepted. All properties sold by the Sheriff’s Office by court order are sold “as is”. It is the buyers’ responsibility to ensure that they are aware of all the legalities of such a purchase and in the event, they are unsure, it is in their best interest to contact a real estate attorney for advice.

Access to foreclosure locations is on our website and is also advertised in the legal section of the Princeton Daily Clarion, generally on Saturdays, beginning approximately six weeks before the sale. The full notice of sale is available at the Gibson County Courthouse and in the newspaper. Notices are also posted within the township of the real estate (generally the libraries, US post office, town hall).

Buyers of these properties become responsible for outstanding liens. It is the buyers’ responsibility to research the property for such liens and to ensure the legal description matches the commonly known street address. The Gibson County Sheriff’s Office does not warrant the commonly known street address as it is listed.

In some cases, there are individuals residing in these properties and as a result, interested individuals cannot view the inside of the property before the sale. If the residents have not vacated the property, it is the responsibility of the purchasing party to file the proper eviction papers through the court system. Furthermore, it is the responsibility of the new purchaser to store personal belongings left by the previous homeowner.

Where can I find out what properties are for sale?

Notices are published in the Princeton Clarion on the first three Saturdays of each month.  Notices are posted at the Gibson County Courthouse, as well as public buildings in the township where the property is located (town hall, post office, library, etc.). Notices of all sales are posted on our website.

Can I tour the property before the sale?

No, the defendant is still the legal owner of the property up until the property is sold and the deed is recorded. The Gibson County Sheriff’s Office does not have keys to the properties that are for sale. Any attempt to view or enter the property without the owner’s permission can be a violation of Indiana’s trespassing laws.

What if someone still lives in the house I just bought?

You may need to file for an eviction through Gibson Circuit or Superior Court.

How does the sale work? Do I do anything ahead of time to be able to bid?

General Information

The sale is a public auction conducted by the Gibson County Sheriff’s Office.

  • An opening bid is typically made by the plaintiff.

  • The Sheriff will accept bids until no further bids are received.

  • The highest bidder will be declared the purchaser.

  • Full payment is due by 3:00 PM on the day of the sale.

  • If the highest bidder does not pay in full by 3:00 PM, the property will be offered to the next highest bidder, who must pay in full by 4:00 PM that same day.

  • Payment must be made by cash or cashier’s check.

  • Personal checks are not accepted.

Failure to Pay

If the highest bidder fails to pay by 3:00 PM, the following Indiana statutes apply:

IC 34-55-6-18 — Failure of Purchaser to Pay; Damages

If the purchaser fails or refuses to pay:

  • The purchaser is liable, upon motion in the proper court with five (5) days’ notice, for:

    1. The purchase money

    2. Damages up to ten percent (10%)

    3. Interest

    4. Costs

  • No stay of execution is permitted on this judgment.

IC 34-55-6-19 — Failure to Pay; Resale; Damages

As an alternative:

  • The Sheriff may resell the property on the same or a subsequent day according to law.

  • If the second sale amount plus costs is less than the first sale amount, the original purchaser is liable for:

    1. The deficiency

    2. Damages up to ten percent (10%)

    3. Interest

    4. Costs

  • Recovery is made by the same notice and motion procedure described above.

  • If resold on a subsequent day, the property must be readvertised as required by law.

Additional Conditions of Sale

  • The Sheriff may cancel the sale at any time prior to the recording of the deed.

  • Sales are made without relief from valuation or appraisement laws.

  • If the sale is set aside for any reason, the purchaser is entitled only to a return of the deposit paid.

  • The purchaser has no further recourse against:

    • The Mortgagor

    • The Mortgagee

    • The Mortgagee’s Attorney

    • The Gibson County Sheriff’s Office

    • The Sheriff

  • The purchaser is responsible for any outstanding taxes.

Indiana law prohibits a person from bidding at a sheriff’s sale if they owe delinquent taxes or other qualifying obligations.

Under IC 6-1.1 and IC 32-29-7-4.5:

  • I do not owe amounts from a final adjudication in favor of a political subdivision.

  • I am not prohibited from bidding under Indiana law.

I understand that knowingly or intentionally providing false information on this affidavit constitutes perjury, a Level 6 felony.

Are there any liens against the properties listed for sale?

There may be liens, and it would be up to you to research that before bidding at the sale. The Gibson County Sheriff’s Office personnel are not aware of any liens and can make no guarantee that there are no liens. We will not knowingly have a sale with delinquent property taxes due, however, we do not guarantee that there are no delinquent taxes due. Once again, you should research this before the sale, it may be to your advantage to have a title search done before bidding on a property at the sale.

When do I take possession of my property if I am the higher bidder?

It usually takes about a week for the deed to be recorded. The Gibson County Recorder will mail you a copy of the recorded deed. At that point, the property is yours, however, if someone is still living at the property, you may have to file for an eviction. It may be to your advantage to hire an attorney to advise you on what needs to be done with personal belongings that may be left at the property and to help you file for an eviction.

We schedule sales on the third Thursday of each month at 10:00 AM. The sales happen quickly, so please be on time, or you may miss the sale that you are interested in. The sales are held in the Community Corrections Conference Room located at 114 E Emerson Street, Princeton, Indiana. On very rare occasions the sale may be held at the location of the property or another location. If that happens, it will be noted on the sale notice. 

Do sales get canceled? How do I know if the sale I'm interested in is canceled?

The attorney for the plaintiff can cancel the sale at any time. They don’t typically provide us with a reason. It could be that the loan payments were caught up, the loan was paid off, the defendant filed for bankruptcy, or any other reason. If a sale is cancelled it may be set for sale again later. My property is listed for sale. How can I stop the sale from happening?

Contact the Indiana Foreclosure Prevention Network to speak to a counselor who can assess your mortgage situation. Call 1-877-GET-HOPE (1-877-438-4673) or go to the following website: www.877GETHOPE.org.

What costs do I have to pay if I am the high bidder?

In addition to the cashier’s check made payable to the Gibson County Sheriff’s Office for the amount of your bid, you will also need to provide us with two checks or cash for the cost of recording the deed. Those checks are to be made out as follows:
